1. Platform as an Intermediary

• 1.1 Bihar Real Estate strictly acts as an online intermediary and an advertising platform connecting buyers, sellers, landlords, tenants, real estate agents, and builders.
• 1.2 We are not a party to, nor do we control, any actual transactions between the users of this Platform. We do not act as a real estate broker, agent, or property consultant for any user unless explicitly stated under a specific premium service.
• 1.3 The Platform does not guarantee the sale, rental, or purchase of any property listed on it.

2. Eligibility

You must be at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872 to use this Platform. By registering on Bihar Real Estate, you represent and warrant that you meet these eligibility requirements.

3. RERA Compliance (For Builders, Promoters, and Agents)

• 3.1 In accordance with the Real Estate (Regulation and Development) Act, 2016 (RERA), it is the sole responsibility of the builder, promoter, or real estate agent to ensure that their project or agency is registered with the Bihar Real Estate Regulatory Authority (Bihar RERA) or the respective state authority.
• 3.2 Any user listing an under-construction project must prominently display the valid RERA registration number and RERA website link in the listing description.
• 3.3 Bihar Real Estate reserves the right to immediately remove any listing that is found to be non-compliant with RERA regulations without any prior notice or refund.

4. User Obligations & Listing Guidelines

By using the Platform, you agree NOT to:

• Post fake, inaccurate, or misleading property listings, photographs, or pricing.
• Post properties that you do not have the legal right or authorization to sell or lease.
• Upload any content that contains watermarks of competing real estate platforms.
• Use any automated software, spiders, or scrapers to extract data, listings, or user contact information from the Platform.
• Upload any viruses, malicious code, or content that disrupts the functionality of the Platform.
• Post any content that is defamatory, obscene, illegal, or infringes upon the intellectual property rights of others.

We reserve the right to suspend or terminate the account of any user found violating these guidelines.

5. Buyer & Tenant Disclaimers (Caveat Emptor)

• 5.1 Independent Verification: The property information, pricing, and photographs provided on the Platform are submitted by third-party users (owners, agents, builders). Bihar Real Estate does not physically verify every property or check the legal title of the listings.
• 5.2 Due Diligence: Buyers and tenants are strongly advised to conduct their own independent legal, financial, and physical due diligence (including checking Bihar Bhulekh records, encumbrance certificates, and RERA approvals) before making any payment or signing any agreement.
• 5.3 No Liability for Fraud: Bihar Real Estate shall not be held liable for any financial losses, property disputes, or fraudulent transactions arising between users.

6. Fees, Payments, and Refunds

• 6.1 While basic browsing and limited property posting may be free, Bihar Real Estate charges fees for premium services (e.g., Premium Listings, featured properties, allied home services).
• 6.2 All payments made to Bihar Real Estate are processed through secure, third-party payment gateways.
• 6.3 Refund Policy: All fees paid for premium listings and subscription packages are generally non-refundable. If a listing is removed by us due to a violation of these Terms or RERA non-compliance, no refund will be issued. Refunds will only be considered in the event of a verified technical failure resulting in double payment.

7. Intellectual Property Rights

• 7.1 Platform IP: All content, designs, logos, software, and databases on the Platform are the exclusive intellectual property of Bihar Real Estate and are protected by Indian copyright and trademark laws.
• 7.2 User Content License: By uploading photographs, property descriptions, or other content to the Platform, you grant Bihar Real Estate a perpetual, worldwide, royalty-free, and transferable license to use, reproduce, modify, and publicly display that content across our network and marketing channels.

8. Limitation of Liability and Indemnification

• 8.1 In no event shall Bihar Real Estate, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of, or inability to use, the Platform.
• 8.2 You agree to indemnify, defend, and hold harmless Bihar Real Estate from any claims, damages, legal disputes, or expenses (including attorney fees) arising from your breach of these Terms, your property listings, or your violation of any third-party rights.

9. Modifications to the Terms

Bihar Real Estate reserves the right to update, modify, or amend these Terms of Use at any time. Any changes will be updated on this page with the revised "Effective Date." Your continued use of the Platform following such modifications constitutes your acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of India. Any legal disputes or proceedings arising out of or related to your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Patna, Bihar.
