Guide for Independent Agents & Brokers

Do you need a RERA Registration to be a real estate agent in Bihar? The short answer is: Not always. Learn how you can legally broker properties and grow your business on Bihar Real Estate without a RERA Agent ID.

1. What Does the RERA Law Actually Say?

There is a common misconception that every property dealer must be registered with RERA. However, Section 9(1) of the Real Estate (Regulation and Development) Act, 2016 clearly states that an agent only requires registration if they are facilitating the sale of a property in a "real estate project registered under section 3".

Simply put: If the property itself is legally exempt from RERA, the agent selling it is also exempt from needing a RERA Agent Registration ID.

2. Properties You Can Legally Broker Without RERA

Independent brokers, freelancers, and local property dealers can freely and legally list, market, and sell the following properties on Bihar Real Estate:

Resale / Secondary Market

Facilitating the sale of a pre-owned flat, individual house, or kothi between a private seller and a private buyer.

Small Plots (< 500 Sq. Meters)

Brokering plots or land parcels where the total development area is strictly under 500 square meters.

Small Buildings (< 8 Flats)

Selling independent builder floors or small apartment buildings containing 8 or fewer units.

Agricultural Land

Dealing in raw agricultural farming land that is not being plotted for commercial residential schemes.

3. When MUST You Have a RERA ID?

You must obtain a valid Bihar RERA Agent Registration Certificate if you intend to:

  • Become an official channel partner for a large builder or developer.
  • Sell fresh inventory in any new apartment complex containing more than 8 flats.
  • Market plotted township developments that exceed 500 square meters.

4. How to List Exempt Properties on Our Portal

We welcome independent brokers! When you create an account and click "Add Property", simply follow these steps to stay compliant:

  1. Fill in the accurate property details, photographs, and pricing.
  2. Navigate to the "RERA Registration Status" dropdown.
  3. Select the appropriate exemption reason (e.g., "Exempt: Resale Property" or "Exempt: Under 500 Sq. Meters").
  4. Check the legal declaration box and hit publish.
Legal Disclaimer for Agents: Bihar Real Estate is an advertising platform and does not provide formal legal advice. While Section 9 of the RERA Act exempts certain transactions, it is the sole responsibility of the real estate agent to ensure the property they are marketing genuinely qualifies for exemption. Attempting to sell RERA-mandated builder inventory without a valid RERA Agent ID is illegal and will result in permanent suspension from this platform.
